Navigating Neighbours
Option 1 - Building a fence directly on the property line
Pre-construction agreement: Secure a written agreement with neighboring landowners detailing fence specifications and shared responsibilities.
Record agreement: Ideally, record this agreement at a local clerk's office to avoid future ownership disputes, should either of the properties change hands.
Joint ownership without cooperation: The fence becomes jointly owned if built on the property line, even without neighbor cooperation.
Neighbour obligations: Neighbours must not intentionally damage the fence. They are permitted to paint it but are not required to contribute to costs or maintenance without an agreement.
Option 2 - Building a fence 6 inches away from property line
Independent construction: Building the fence just inside your property line eliminates the need for neighbor approval for construction or maintenance.
Neighbour relations: This approach does not guarantee neighbor support for the fence or protect against potential resentment.
